The present Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that Polistroykapital LLC can obtain about the User while using the site located at the address (on the domain name): https://topazresidencesbytasigo.ru, including all levels of the specified domain and the pages contained on them (hereinafter referred to as the Site), as well as during the execution of any agreements and contracts with the User by the Site Administration.1. Terms and definitions
1.1. Site Administration (hereinafter referred to as the Administration): employees authorized to manage the site, acting on behalf of Polistroykapital LLC, who organize and/or carry out the personal data processing, and also determine the purposes of the personal data processing, the composition of the personal data to be processed, actions (operations) performed with the personal data.
1.2. Personal data: any information relating to a directly or indirectly identified or identifiable individual (subject of personal data).
1.3. Personal data processing: any action (operation) or set of actions (operations) performed with personal data, using automation tools or without the use of such tools, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.4. Personal data privacy: legally binding requirement for Polistroykapital LLC or any other person who has obtained access to personal data not to allow their distribution without the consent of the subject of the personal data or the presence of another legal basis.
1.5. Site user (hereinafter referred to as User): person who has access to the Site via the Internet and uses the Site.
1.6. Cookie file: small file that contains a string of characters and is sent to your computer when you visit a particular page. The website uses it to identify the browser when you visit the same page again. Such files are used for various purposes: e. g., they allow to remember user settings. Users can prevent their browser from storing cookie files or enable notifications about those latter. However, this sometimes leads to incorrect operation of sites and services.
1.7. IP address: unique network address of a node in a computer network built using the IP protocol.
2. General provisions
2.1. The use of the Site by the User involves the agreement herewith and with the terms of processing of the User’s personal data. In case of disagreement herewith, the User shall cease using the Site.
2.2. The present Privacy Policy applies to the Site only. This Site shall not control nor be responsible for third party sites that the User can access via links available on the Site.
2.3. The Site Administration shall not verify the accuracy of the personal data provided by the Site User.
2.4. The text and provisions hereof may be changed at any time by the Site Administration without prior notice. If the User disagrees with the changes made or the terms of use of the materials and services of the Site by the User, he/she shall refuse access to the Site and cease using the materials and services of the Site from the date the changes made come into force.
2.5. The new Privacy Policy comes into force from the moment of it is posted on the Site, unless otherwise provided by the new edition of the Privacy Policy. The link to the current Privacy Policy is posted on all pages of the Site (at the bottom of each page of the Site).
3. The Privacy Policy subject
3.1 The present Privacy Policy establishes the obligations of the Site Administration to non-disclose and ensure a regime for protecting the privacy of the personal data that the User provides when using the Site.
3.2 The personal data permitted for processing hereunder shall be provided by the User by filling out registration forms on the Site, and may also be collected to provide access to the Site functionality. The User shall consent to the processing of his/her personal data that are not special or biometric including but not limited to the following data: personal name, surname, contact telephone number, electronic mail address, place of work and its details, position occupied, custom data (location data, operating system type and version, browser type and version, device type and screen resolution, source of transition to the Site, including the Site address: 2 sources and the text of the advertisement and/or link posted on it –, language of the operating system and browser, list of pages visited and actions performed on them, IP address, information from cookie files).
3.3 The present Policy applies only to the information processed when using the Site. The Site Administration shall not control nor be responsible for third party sites that the User can access via links available within the Site.
3.4 The Site Administration shall not verify the accuracy of the personal data provided by the Site User, and does not have the ability to assess his/her legal capacity. However, the Site Administration shall assume that the User provides reliable and sufficient personal data and keeps them up to date.
4. Purposes of collecting the User’s personal information
4.1 The Site Administration shall process the personal data solely to provide full or partial functionality of the Site in accordance with the User Agreement, to provide information services to the User and/or to fulfill agreements and contracts with the User. The Site Administration shall process the User’s personal data for the following purposes:
4.1.1. to provide full or partial access to the materials and functionality of the Site;
4.1.2. to identify the User during the processing of applications for participation, registration and organization of participation of the User and/or the company of which the User is a representative in the events of Polistroykapital LLC;
4.1.3. to execute other agreements and contracts with the User and/or the company of which the User is a representative;
4.1.4. to provide the User with notifications, news, invitations, special offers, information about events and other information on behalf of Polistroykapital LLC;
4.1.5. to provide the User with detailed information about services proposed and decisions taken by participants of events organized by Polistroykapital LLC;
4.1.6. to establish feedback with the User, including sending notifications, requests concerning the Site use, processing requests and applications from the User;
4.1.7. to determine the User’s location for ensuring security and preventing fraud; to confirm the accuracy and completeness of the personal data provided by the User;
4.1.8. to provide the User with efficient customer and technical support if there are problems related to the Site use.
5. Methods and terms for processing the personal information
5.1. When processing Users’ personal data, the Site Administration is guided by the Federal Law No. 152-FZ On Personal Data, dated July 27, 2006, and other regulations of the Russian Federation.
5.2. The User’s personal data processing shall be carried out without any time limit, by any legal method, including in personal data informational systems using automation tools or without the use of such tools. The personal data processing can be carried out by collection, systematization, accumulation, storage, clarification (updating, changing), use, transfer, depersonalization, blocking, and destruction.
5.3. The consent to the personal data processing can be withdrawn by the User by submitting an application to the Site Administration indicating the information specified in art. 14 of the Federal Law On Personal Data. The withdrawal of the consent to the personal data processing can be carried out by sending a corresponding application by the User in free written form to the electronic mail address specified in section 8 hereof.
5.4. The User’s personal data remain confidential, except in cases where the User voluntarily provides information about him- or herself for general access to an unlimited scope of persons.
5.5. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, to courier services, postal organizations, telecommunication operators, solely for the purpose of collecting and processing statistical information, fulfilling orders and/or agreements, organizing the User’s participation in events and his/her receiving information about services offered and decisions of participants in events held by Polistroykapital LLC.
5.6. The User’s personal data may be transferred to authorized government bodies of the Russian Federation only on the grounds in the manner established by the legislation of the Russian Federation.
5.7. The User or his/her legal representative may at any time change (update, complete) the personal data provided by him/her or a part of them using the function of editing personal data in the personal section of the Site or by sending a corresponding request to the electronic mail address specified in section 8 hereof.
5.8. The User or his/her legal representative has the right to demand blocking or destruction of the provided personal data in case of refusal to use the Site and/or refusal to participate in the events of Polistroykapital LLC by sending a corresponding request to the electronic mail address specified in section 8 hereof.
5.9. The Site Administration shall take the necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, changing, blocking, copying, distribution, as well as from other unlawful actions of third parties.
6. Obligations of the parties concerned
6.1. The User shall:
6.1.1. Provide the information on the personal data necessary for using the Site and organizing the participation of the User and/or the company of which the User is a representative in the events held by Polistroykapital LLC;
6.1.2. Update, complete the provided information on the personal data in case this information changes.
6.2. The Site Administration shall:
6.2.1. Use the information obtained solely in the purposes specified in section 4 hereof;
6.2.2. Ensure that the confidential information is kept secret, not disclosed without the User’s prior written permission, and also not sell, exchange, publish, nor disclose the transferred User’s personal data by any other possible methods, except for sections 5.4., 5.5. and 5.6. hereof;
6.2.3. Take precautions to protect the User’s personal data privacy in accordance with the procedure normally used to protect this type of information in existing business transactions;
6.2.4. Block the personal data relating to the relevant User from the moment of application or request from the User or his/her legal representative or the authorized body for the protection of the rights of personal data subjects for the verification period, in case of detection of unreliable personal data or unlawful actions.
7. Final provisions
7.1. The present Privacy Policy is governed by and construed in accordance with the legislation of the Russian Federation. Issues not regulated hereby shall be resolved in accordance with the legislation of the Russian Federation.
7.2. All disputes and disagreements regarding the present Privacy Policy shall be resolved through negotiations, and if no agreement is reached, they shall be referred to the appropriate court of the city of Moscow (according to the dispute jurisdiction).
7.3. The recognition by the court of any provision hereof as invalid or unenforceable shall not entail the invalidity of other provisions hereof.
7.4. The present Privacy Policy comes into force for the User from the moment he/she begins using the Site, and is valid for an indefinite period. The User shall confirm that he/she is aware of all the sections hereof and unconditionally accepts them.
